Terms of Service

These Terms of Service ("Terms") govern your access to and use of Kevanta at https://kevanta.in ("the Service"), which provides WhatsApp marketing, chatbot and messaging automation built on the WhatsApp Business Platform. By creating an account or using the Service you agree to these Terms.
1. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract.
- You are responsible for the accuracy of your account information and for all activity under your account.
- Keep your credentials confidential. Tell us immediately at support@kevanta.in if you suspect unauthorised access.
2. Your responsibilities when messaging
You are the sender of every message you dispatch through the Service. You must:
- Obtain and retain proof of opt-in consent from every recipient before messaging them.
- Honour opt-out ("STOP") requests promptly and permanently.
- Comply with the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy and Meta's Platform Terms.
- Comply with all applicable laws on marketing, telecommunications, consumer protection and data protection in every jurisdiction you message into.
Meta may restrict, suspend or terminate your WhatsApp Business Account for policy violations. That decision rests with Meta, not with us, and we cannot reverse it.
3. Prohibited use
You may not use the Service to:
- Send unsolicited bulk messages, spam, or messages to purchased or scraped contact lists.
- Send content that is unlawful, fraudulent, deceptive, harassing, hateful, or that infringes another party's rights.
- Distribute malware, run phishing campaigns, or impersonate any person or organisation.
- Circumvent rate limits, resell the Service without written agreement, or reverse engineer any part of it.
4. Subscriptions, billing and refunds
- Paid plans are billed in advance on a recurring basis until cancelled.
- Charges are non-refundable except where required by law or as stated in our Refund Policy.
- You may cancel at any time; access continues to the end of the current billing period.
- We may change pricing with at least 30 days' notice before it applies to your next renewal.
5. Third-party services
The Service depends on the WhatsApp Business Platform and other third parties (payment processors, cloud hosting). Their availability, pricing and policies are outside our control, and changes they make may affect the Service.
6. Availability
We work to keep the Service available but do not guarantee uninterrupted operation. We may suspend access for maintenance, security, or where continued use would breach these Terms or endanger the platform.
7. Your data
Our handling of personal data is described in our Privacy Policy. You can request deletion of your data at any time - see our Data Deletion Instructions. You retain ownership of the content and contact data you upload; you grant us only the licence needed to operate the Service on your behalf.
8. Suspension and termination
We may suspend or terminate your account for breach of these Terms, non-payment, or where required by law or by Meta. You may close your account at any time from the console or by emailing support@kevanta.in.
9. Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. We are not liable for indirect, incidental or consequential damages, or for lost profits or lost data. Our total aggregate liability is limited to the amount you paid us in the 12 months preceding the claim.
10. Indemnity
You agree to indemnify Kevanta against claims arising from your messages, your content, or your breach of these Terms or of Meta's policies.
11. Changes to these Terms
We may update these Terms. Material changes will be notified by email or in-app at least 15 days before taking effect. Continued use after that constitutes acceptance.
